Terms of sale

Article 1 — Purpose and scope

These terms of sale (“Terms”) govern all sales of personalised photo products (photo books, prints, posters, wall art — the “Products”) concluded between DEVLOPN, société à responsabilité limitée (SARL) au capital de 100 € (the “Seller”) and any consumer (the “Customer”) through the Tikipik mobile app.

Placing an order implies prior, express and unreserved acceptance of these Terms, available at any time in the app and on tikipik.com. These Terms are governed by French law. The French version prevails.

Article 2 — Products

Products are made to order from the Customer’s photographs and personalisation choices (format, cover, paper, finishing options). Essential characteristics are presented in the app before ordering.

A faithful preview is displayed before validation. The Customer is solely responsible for the printed content and warrants holding the necessary rights over the imported photographs (copyright, image rights of the persons depicted), and shall not submit unlawful content.

Article 3 — Prices

Prices are in euros, all taxes included, excluding delivery costs, which are shown before order validation. The total price including delivery is displayed before payment.

The Seller may change its prices at any time; Products are invoiced at the rate in force when the order is validated.

Article 4 — Order and payment

The order is validated after acceptance of the summary (Products, price, delivery address) and full payment, made securely online via our provider Stripe. The order is confirmed by email and can be tracked in the app.

The Seller reserves the right to refuse any order containing manifestly unlawful content or content contrary to Article 2.

Article 5 — Delivery

Products are manufactured and shipped to the address provided by the Customer: within 2 days for posters, within 4 to 6 working days for other Products, and in any event within the 30-day maximum period provided by Article L216-1 of the French Consumer Code.

If this period is exceeded, the Customer may direct the Seller to deliver within a reasonable additional period and, failing that, terminate the sale (Articles L216-6 et seq.). Risk passes to the Customer upon physical delivery.

Article 6 — No right of withdrawal; cancellation

As the Products are made to the Customer’s specifications and clearly personalised, the 14-day right of withdrawal does not apply, in accordance with Article L221-28 3° of the French Consumer Code (implementing Directive 2011/83/EU). The Customer is expressly informed of this before validating the order.

The Customer may nevertheless cancel the order free of charge, directly in the app, as long as manufacturing has not started. The refund is then made within 14 days at most, using the same payment method.

Article 7 — Statutory warranties and quality commitment

Independently of any commercial warranty, the Customer benefits from the French statutory warranty of conformity (Articles L217-3 to L217-14 of the Consumer Code — two years from delivery) and the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code).

Quality guarantee: any printing or manufacturing defect attributable to the laboratory, as well as any damage occurring during transport, reported with supporting photos, gives rise to a reprint of the Product or a refund, free of charge. This guarantee covers neither mere dissatisfaction with the aesthetic result, nor defects resulting from the content provided (insufficient photo resolution despite the sharpness warning, cropping and texts approved by the Customer in the preview).

Article 8 — Liability

The Seller shall not be liable for non-conformities resulting from content provided by the Customer (insufficient photo quality despite the sharpness warning displayed, text errors approved by the Customer, third-party rights) or in cases of force majeure within the meaning of Article 1218 of the French Civil Code.

Article 9 — Personal data

The Customer’s personal data is processed in accordance with the privacy policy available on tikipik.com, which forms an integral part of these Terms.

Article 10 — Consumer mediation and disputes

In accordance with Articles L612-1 et seq. of the French Consumer Code, after first contacting the Seller in writing without success, the Customer may refer the matter free of charge to the following consumer mediator: [À COMPLÉTER : médiateur de la consommation — nom, adresse, site web].

Failing an amicable resolution, disputes fall within the jurisdiction of the competent French courts.
